We are the data controller for the purposes of this Privacy Policy.

2. Scope & Applicability

This Privacy Policy applies to all users of the App in the United States. At present, the App is offered in the U.S. only. If we expand to other jurisdictions, we may update this policy accordingly.

We reserve the right to modify or update this policy at any time. When we do so in a material way, we will display an in-app notice (such as a pop-up) and require your acceptance in order to continue using the App.

3. Information We Collect

3.1 Information You Provide

When you register with the App and create your account, we may collect the following information:

• Full name
• Email address
• Phone number
• Date of birth
• Gender
• Height & weight
• Fitness goals and challenges
• Workout intensity and frequency
• How often you eat out
• Photos you may upload (optional)

3.2 Automatically Collected / Generated Information

We also collect information automatically or via your device:

• Device identifiers (e.g., device ID, advertising ID)
• IP address and general device information (model, OS version, locale)
• Usage logs and analytics data (how you use the App, crashes, etc.)
• Location / GPS data (precise polling every 5-15 minutes ideally, when you permit – including background usage)
• Biometric & health-related data (calorie intake, weight changes over time, steps, heart-rate)
• Cookies, local storage, and other tracking technologies

3.3 Third-Party & External Services

We integrate third-party services such as analytics, crash-reporting, advertising, payment processors (e.g., Google Analytics, Sentry, PostHog, Stripe, SuperWall) which may collect or process your data.

4. How and Why We Use Your Information

We use the information we collect for the following purposes:

• To create and maintain your user account
• To provide, operate and improve the App, including personalization of content and recommendations
• To enable location-based features (e.g., store-geofence triggers)
• To process payments, subscriptions, and for fraud detection
• To communicate with you (push notifications, emails, service messages)
• To conduct analytics, crash reporting, usage tracking and monitoring
• To send marketing/promotional materials (only if you opt-in)
• To enforce our Terms of Service and ensure security

We retain your information for as long as your account is active and thereafter at our discretion.

5. Location, Health & Sensitive Data

Because the App processes precise geolocation, biometric/health-related data, steps and heart-rate:

• You will be asked for permission prior to the collection of location data or health/biometric data via your device.
• You may opt-out of location polling; however, if you opt-out, some location-based features may degrade (e.g., store-geofence triggers).
• Although we retain data indefinitely, sensitive health or biometric data will be encrypted, anonymized and treated with additional safeguards.

6. Sharing & Disclosure of Your Information

We do not sell your personal data to third parties. We may share your information with:

• Payment processors and billing services (e.g., Stripe, SuperWall) for subscription management
• Analytics and crash-reporting services (e.g., Google Analytics, Sentry, PostHog)
• Advertising partners in aggregated, anonymized form for product improvement and marketing
• Our internal staff and affiliates who need access to perform services
• Legal authorities or other third parties if required by law or to protect our rights

7. International Data Transfers

Currently, your data is processed and stored within the United States and is not knowingly transferred to other jurisdictions. If this changes, this policy will be updated accordingly.

8. Your Rights & Choices

• Account deletion / closure: You may request deletion or deactivation of your account by emailing hello@fitnibz.com. Upon deletion, access will be terminated; however, we may retain anonymized or aggregate data.
• Location permission: You may disable or withdraw location permission via your device; note some features will then degrade.
• Marketing communications: You may opt-out of marketing emails or push notifications by following unsubscribe instructions or emailing hello@fitnibz.com.

Please note that at present, because of the nature of our service (personalization, profiling, analytics), you may not be able to opt-out of all automated processing (e.g., recommendations) though you can disable certain features (like location) and withdraw marketing consent.

9. Security

We implement reasonable technical and organisational measures to safeguard your data: encryption at rest and in transit, authentication and access controls, regular auditing, backups and version control. Nevertheless, no security system is impenetrable and we cannot guarantee absolute security.

10. Cookies & Tracking Technologies

We use cookies, local storage and other device-based identifiers to support functionality, personalize the experience, conduct analytics and deliver (if applicable) targeted advertising. You can manage cookie preferences via your browser or device settings — however, disabling cookies may affect the usability of the App.

11. Children's Privacy

Our services are not intended for children under 13 years of age. We do not knowingly collect information from children under 13. If you believe we have inadvertently collected such information, please contact us at hello@fitnibz.com and we will delete that data.

12. Changes to this Policy

We may update this Privacy Policy from time to time. When we make material changes, we will display a pop-up in the App and require your acceptance before you continue using the App. We will also update the "Last Updated" date above.
